We operate the website Paywaysol.com (the “Site”), the mobile application Gen. (the “App”), and providing a digital health identification service (the “Service”) through our smart bracelet product (the “Bracelet”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, as a guardian or user (the “Guardian”, “you”), and Payway Solutions Company for Wholesale and Retail Trade and concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted. 

OUR SERVICE

The Service enables Guardians to store and manage medical and emergency information of children via an NFC-enabled Bracelet. When scanned by any NFC-compatible mobile phone, the Bracelet directs you to a unique Medical ID web page displaying the child's information, including:

• Student Name*/ Student Photo
• Student Civil ID
• Emergency Contact (Name and Mobile Number)*
• Date of Birth*
• Gender*
• Civil ID Number
• Blood Type*
• Weight
• Height
• Medical Conditions
• Medications
• Allergies
• Address

Fields marked with (*) are mandatory.

This service is intended to assist in identifying a lost child and enables the person scanning the Bracelet to send their location to the Guardian.

SUBSCRIPTIONS AND PAYMENTS

The Service is available through monthly or annual subscription plans through our website. Subscriptions will auto-renew unless cancelled before the end of the billing cycle.

Fees will be charged to the payment method provided by you.

We accept the following forms of payment:

- Visa

- Mastercard

- Knet

 

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in Kuwaiti Dinars.  

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

You may update the payment method or cancel your subscription at any time through your account dashboard.

In the event of a lost or damaged Bracelet, a replacement can be ordered for a one-time fee that includes the cost of the Bracelet and delivery.

All payments and history will be accessible via the Guardian’s account on the Site.

LICENSE TO USE THE SERVICE

Subject to your compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, and revocable license to access and use the Site and Service solely for your personal, non-commercial use.

You agree not to:

• Reverse engineer, modify, copy, distribute, or create similar works based on any part of the Service.
• Use the Service in a way that interferes with its normal operation or attempts to bypass its security.

 

ACCOUNT MANAGEMENT

The Guardian is responsible for creating and managing the child’s Medical ID.

The Guardian may update, delete, or edit any of the information added.

Guardians have the right to delete their accounts entirely, which will result in permanent deletion of all stored data.

MEDICAL DISCLAIMER

The Company does not provide medical advice, diagnosis, or treatment.

The Company is not responsible for any medical reactions caused by wearing the Bracelet, including allergies to bracelet materials.

It is the Guardian’s responsibility to consult with healthcare professionals and ensure the accuracy of all medical information they have entered.

PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

• Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
• Engage in unauthorized framing of or linking to the Services.
• Trick, defraud, or mislead us, especially in any attempt to learn sensitive information
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Use any information obtained from the Services in order to harass, abuse, or harm another person.
• Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.
• Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
• Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
• Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or using or launching any unauthorized script or other software.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
• Use the Services in a manner inconsistent with any applicable laws or regulations.

 

PRIVACY AND DATA

We are committed to protecting your privacy. We care about data privacy and security. Please review our Privacy Policy: paywaysol.com. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.

Data is securely stored and will be permanently deleted upon user request as quickly as is reasonably practical.

 

LIMITATIONS OF LIABILITY

We are not liable for any indirect, incidental, special, or consequential damages arising from the use of the Service.

Our liability under these Terms is limited to the amount paid by you for the Service.

 

INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of:

• Your use or misuse of the Service.
• Your violation of these Terms or applicable law.
• Any data or content you provide through the Service.

 

INTELLECTUAL PROPERTY

All content, trademarks, software, and materials related to the Service are the property of Payway.

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.

The Content and Marks are provided in or through the Services “AS IS” for your non-commercial use only.

You may not reproduce, duplicate, modify, or exploit the Service or any part thereof without our prior written consent.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

 

TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action.

 

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait.
